Before Full Payment: All website designs, code, graphics, content, and other deliverables created by WebGlow remain the exclusive intellectual property of WebGlow until full payment is received. The client may not use, copy, distribute, or deploy any work product prior to full payment.
After Full Payment: Upon receipt of full payment, ownership of the final, delivered website code and design transfers to the client. WebGlow retains the right to display the completed project in our portfolio and marketing materials, unless otherwise agreed in writing.
Third-Party Materials: Any third-party plugins, fonts, stock images, or software used in the project remain subject to their respective licenses. WebGlow is not responsible for licensing restrictions imposed by third parties.
Client-Provided Content: The client warrants that all content, images, and materials provided to WebGlow for use in the project do not infringe on any third-party intellectual property rights.
The following terms apply specifically to purchases made through our online shop for NFC Google Review Cards:
To the maximum extent permitted by South African law, WebGlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Website or services.
WebGlow's total liability for any claim arising from services provided shall not exceed the amount paid by the client for the specific service giving rise to the claim.
We do not guarantee specific search engine rankings, Google Ads performance, or business results, as these are influenced by factors outside our control, including search engine algorithms and market conditions.
WebGlow is not liable for any downtime, data loss, or issues caused by third-party hosting providers, payment processors, or courier services.
These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the South African courts.
Our services and these Terms comply with the South African Consumer Protection Act (Act 68 of 2008) where applicable.
